Privacy Policy

1. General Provisions

1.1 This Privacy Policy (hereinafter referred to as the “Policy”) was developed by the Limited Liability Partnership “Vnedrah” (Legal address: 101301, Republic of Kazakhstan, Ulytau region, Satpayev city, BIN 220840020296 , hereinafter referred to as the “Partnership” and/or “Portal Administration”) in accordance with the current legislation of the Republic of Kazakhstan, including, but not exclusively, the Law of the Republic of Kazakhstan dated May 21, 2013 No. 94-V “On personal data and their protection”, establishes the procedure for obtaining, collecting, accumulating, storing, processing, using, ensuring the protection and disclosure of personal data (hereinafter referred to as the “Data”) using the vnedrah.com portal (hereinafter referred to as the “Portal”) and/or mobile application and/or related services and tools.

1.2 Data means any information relating directly or indirectly to a specific User. This may be: first name, last name, patronymic (if available), email address, telephone number, region of residence, address of place of residence/stay, information about the User’s actions on the Portal, IP address, data about the devices used by the User (computer, type browser, mobile device operating system), messages (information contained in correspondence between Users with each other, as well as in correspondence with the Portal Administration), other communication information that, at the User’s request, is provided to them through the registration form and/or when filling out your Profile on the Portal, writing a message and/or review, or information received through oral communication between Users and the Portal Administration, information that is provided when making a payment and/or using by the User any service provided by the Portal Administration.

1.3 Data processing means any action with Data, including, but not limited to: access, provision, distribution, collection, systematization, storage, accumulation, recording, transfer, blocking, deletion, clarification, updating and/or change, depersonalization and others ways of using Data by the Portal Administration.

1.4 The owner of the database containing personal data is the Limited Liability Partnership “Vnedrakh”.

1.5 The user, by registering on the Portal, entering his personal data and/or providing this data in another way, and/or performing any actions within the Portal and/or using any part of the Portal and/or, by expressing consent, by activating the button " register” through the Portal form expresses his agreement with the provisions of this Policy and gives the Portal Administration, as well as third parties who provide the Portal Administration with services related to the functionality of the Portal (payment for services, delivery arrangements) permission to process their Data.

1.6 Users can provide Data independently by posting it on the Portal or reporting it through telephone communication channels and/or to the email and/or postal address of the Portal Administration, by filling out questionnaires (filling out a questionnaire or in another way), or Data may be provided from other sources (in in accordance with clause 3 of this Policy) for example, User reviews (ratings, comments, confirmation of information) or other information from third parties provided during the submission of claims, complaints and/or dispute resolution, and/or information from publicly available sources on the Internet .

1.7 The User has no right to use the Portal if he does not agree with the terms of this Policy.

2. Collection of personal data

2.1. First name, last name, patronymic (if available), passport details, individual identification number, date of birth and/or age, gender, marital status, details of the company’s authorized person, company name, company details, contact numbers, email address, location address companies, other communication data at the request of the User (for example, place and / or address of work), payment card numbers, payment card tokens;

2.2. Information about the User's account (in particular login, phone number), email address, login and password, account processing data, other data necessary for servicing the Portal Users, communications with Users, including in the process of the User contacting the service Portal support;

2.3. Information that Users provide to the Portal Administration and other end performers when concluding agreements for the provision of services by accepting a public offer posted on the Portal;

2.4. Information necessary for communications between Portal Users, including for carrying out and confirming transactions betweenbetween sellers and buyers, receiving and sending messages, posting reviews, comments, making payments, to fulfill requests from Users and receive feedback from the User if necessary, information posted by Users based on the results of their service, reviews, comments, calls to customer support , complaints, claims, other appeals;

2.5. Data about the devices used by the User, information about the Users’ websites and/or their mobile Data (in case the User uses a mobile application) such as: IP address, date and time when the User uses the Portal, information about software, and also the Internet browser used, information about the operating system of the mobile device, information about the operation of the User’s devices, individual identifiers of the devices used by the Users;

2.6. Data obtained as a result of various surveys conducted by the Portal Administration and/or third parties authorized by the Portal Administration in order to improve the provision of services to Users; information received by the Portal Administration as a result of marketing activities;

2.7. Information about the User’s actions on the Portal (consumer behavior regarding the purchase of goods, performance of work, provision of services on the Portal) information based on the results of communication with other users, including information left by users in review forms, ratings, comments or any other feedback from users ; information on the basis of which ratings are formed, any other information that users post on the Portal as a result of interaction with other users and which enables the Portal Administration to take the necessary measures in order to maintain quality service and avoid fraudulent activities on the Portal;

2.8. Information posted or provided to Users in the process of their participation in bonus programs, quizzes, promotions, special offers that are held on the Portal and organized by the Portal Administration;

2.9. Information received from Users by filling out questionnaires or otherwise brought to the attention of the Portal Administration (this may include, but not exclusively, information about: citizenship, place of birth, education, profession, specialization, length of service, social status, family composition (surname , name, patronymic of such persons, their gender, age, place of registration and residence, contact details), photo, video image of the User (and/or the User’s authorized person, etc.);

2.10. The information was received by the Portal Administration in a legal manner from partners and/or third parties.

2.11. The Portal Administration can also process Data using the following technologies:

- Cookies (cookies are a small piece of data that is sent to the user’s computer when navigating to a web page and/or when viewing an advertising module on a web page and stored on the user’s computer and/or mobile device);

- pixels (pixels – digital images, an element of a matrix of displays that form an image), allowing to track how often the User uses a web page in order to determine the User’s browser and provide services, for example, storing Data in the basket between visits; and also in order to eliminate errors in the operation of the Portal initiated by the User, all information is processed “as is” and does not change during the Data collection process.

3. Use and purposes of Data processing

3.1 The Portal Administration uses and processes Data for the purposes of:

- identification of the client as a User of the Portal, including for the provision of services, payment processing, sending settlement transactions, reporting, maintaining accounting and management records, creating and implementing bonus programs, loyalty programs;

- forming ratings, analyzing User activity, searching using keywords, managing traffic on the Portal, analyzing and forecasting preferences and interests of Users; conducting research and analytical activities, as well as ensuring compliance by Users with the terms of the User Agreement, Rules for posting information on the Portal, Rules for publishing reviews, Rules for registration of product items, Rules for posting advertisements;

- sending mailings, commercial offers, messages about promotions, loyalty programs, bonus programs and/or for the purpose of sending messages about the functioning of the Portal;

- provision by the Administration of the Portal of Internet services of the Portal, exchange of information;

- Cookies for the purpose of transmitting information about User actions on the Portal to Google partners: social networks and advertising companiesand web analytics. Our partners may combine this information with information provided by Users, as well as information they receive from your use of their services;

can exchange data with end performers who provide Services on the Portal, who can process and use Data for the purpose specified in section 3 of this Policy.

3.2 The Portal Administration does not process Data relating to race, nationality, political views, religious and other beliefs, or membership in public associations. Information that characterizes the physiological characteristics of Users, on the basis of which it is possible to establish their identity, is not processed.

3.3 The terms of processing and storage of Data are determined based on the purposes of Data processing, as well as on the basis of the conditions specified in contracts concluded with Users in accordance with the requirements of the current legislation of the Republic of Kazakhstan.

4. Access to Data

4.1 Disclosure of Data is made when the User orders goods/services on vnedrah.com to the seller/supplier of such goods/services, but only to the extent necessary to identify the User and his order.

4.2 In some cases, in order to demonstrate the effectiveness of the Portal and improve the image of the Portal, the Portal Administration may disclose statistics on the operation of Users’ websites, without disclosing personal data and information that is a trade secret.

4.3 The Portal contains links to other web resources when navigated by Users, which are not covered by this Policy.

4.4 Data is not disclosed to third parties and is not distributed without the consent of the User, except in cases provided for by the current legislation of the Republic of Kazakhstan and only in the interests of national security, economic well-being and human rights, in particular, but not exclusively:

- upon reasonable requests from government bodies that have the right to request and receive such data;

- if there is reasonable suspicion that the User has violated the terms of this Policy and/or other contracts and agreements concluded with the User, as well as the provisions of the User Agreement, Rules for posting information on the Portal, Rules for publishing reviews, Rules for registration of product items, Rules for posting advertisements.

4.5 The Administration of the Portal reserves the right, in accordance with the requirements of the current legislation of the Republic of Kazakhstan, to exchange Data with government agencies in order to: prevent fraud on the Portal, resolve disputes and clarify circumstances that may be/cause a violation of current legislation, as well as in the event identification by the Portal Administration of unlawful actions of Portal Users and/or receipt of claims, complaints, requests from third parties.

5. Change of Data

5.1 Users can at any time change/delete personal information or refuse to send messages, or withdraw their consent to Data processing through their Personal Account or by contacting one of the communication options on the Portal.

5.2 Upon receipt of such notification, the processing of the User's Data will cease and his Data will be deleted, except in cases where such processing may be necessary in accordance with the current legislation of the Republic of Kazakhstan.

5.3 The operation of some Portal features that require information about the User may be suspended from the moment the Data is changed/deleted.

5.4 The Administration of the Portal processes and stores Data to implement the purposes specified in this Policy throughout the entire necessary period for this, but not more than 5 (five) years from the date of the User’s last interaction with the Portal.

6. Data Protection

6.1 The Administration of the Portal, when processing Data, applies all necessary technical, organizational, legal measures to protect Data from unlawful and/or unauthorized access to such Data, including modification, deletion, provision, distribution, as well as other unlawful actions.

6.2 The Administration of the Portal constantly monitors the security measures taken.

6.3. The User acknowledges that if he is negligent about the security and protection of his Data and authorization data (password, login), third parties may gain unauthorized access to the User’s account and Data. The Portal Administration is not responsible for losses caused by such access.

7. Additional terms

7.1 The Portal Administration reserves the right to change the terms of this Policy at any time. In this case, the updated version will be posted on the main page of the siteta vnedrah.com. If the User does not agree with the changes, he undertakes to immediately stop any use of the Portal.

7.2 If the provisions of this Policy, paragraphs or part thereof, are recognized as contradicting the current legislation of the Republic of Kazakhstan, or invalid, this fact will not in any way affect the remaining provisions of this Policy, they remain in full force and continue to be in full force and effect force and are valid, and any invalid provision, or provision that cannot be enforced without further action by the Parties, is deemed to be changed, corrected to the extent necessary to ensure its validity and enforceability.

7.3 Terminology used in this Policy has the same meaning as in the User Agreement unless otherwise stated.
